Therefore, the duty incumbent on the Municipality does not appear to be limited to a periodic survey of the demographic data for the purpose of identifying new offices to be established in the municipal area, in application of the new demographic parameter envisaged from 2012, but that the state legislator assigns the task to the municipalities to identify the areas in which to locate the pharmacies, expression of the principle of vertical subsidiarity, in line with the need to ensure an orderly structure of the territory, corresponding to the actual needs of the community, a task that is expressed in discretionary assessments made by the local authority;

More specifically, the periodic review, “in the form” of a new determination of the territorial districts, appears necessary when significant changes have occurred in the distribution of the municipal population;

On the basis of the provisions transcribed above, in urban realities while not recording "substantial variations in the total number of inhabitants", but in a territorial context in which the establishment of the boundaries of the districts dates back over time, so much so that it can be considered absolutely obsolete, and where There have been very significant changes in the distribution of the population and in the morphology of the territory, it emerges the duty of the Municipality to provide for the revision of the organic plant in line with the change over the years of the Municipal structure.
